Q: Wife and Daughter hit head on with serious injuries. Will the guy who crossed the yellow line be criminally liable?

All he got were 4 violations, the worst of which was Careless Driving. He has a prior DUI from 2013, but police said there was no indication of that this time. There was no blood drawn. These violations were entered in county court on November 2nd 2018 and I believe he has 10 days to make a plea which he still has not. It is Nov 13 now.

Questions are: If he doesn't respond or plea one way or another, what happens to him? If he pleads Guilty, then he just pays the fines and that's it? No jail? No nothing?.... and my wife and daughter have to justice? They will make full recovery, but are definitely scarred. FYI, yes were are going after him civilly through insurance companies but I want him to pay criminally. Thoughts?

A: Unless he committed a criminal violation there is no jail time, regardless of injuries. I suggest that you be sure you have a good lawyer for the head injuries, and look also at the crashworthiness aspects given the degree of injury.
