Mc Lean, VA asked in Personal Injury for Virginia

Q: Hello, my name is Danielle Gallegos and I am in Colorado. My daughter has brain cancer and I am a single parent.

I had to start a job in Aug on 2018 at night. I never called in despite ongoing treatments. I took on a new position here thinking my daughter was okay, and a second tumor was found. I still took the job despite the stress of more treatments. Since I have had to call in for medical emergencies. I have been treated unfair and not very kind due to my circumstances. I have been written up, and yesterday had to rush my daughter to the emergency room for a high grade fever. I recorded standard protocol, and resumed worked leaving her at Children's alone. I am now being threatened by my acting boss and HR. I came back to work to make up hours and I am staying late this evening as well. I feel like I am the only one that is unable to do these as everyone else shifts seem to be able to be tailored. My daughter is 14, terminal and I am barley able to be with her most days due to working this full time job. I am losing everything. What are my rights? Am i at fault for trying to keep my daughter?

A: I am very sorry to hear about your daughter's illness and the stress you are under. I regret that I am located in Virginia and do not handle employment cases or personal injury cases. Sorry. You should talk with a lawyer in Colorado.

A: I'm sorry about your daughter's illness. You need to speak with an employment lawyer; your question is posted under Personal Injury. See if the site administrators will help you take down your personal information or delete your post and upload from scratch, where you could include Employment Law as a category. There's no good reason for you to include personal information here. If you repost or add a category, hopefully an employment lawyer could pick up your question.

You could also simply contact employment lawyers in Colorado you find on this site (under Find a Lawyer), on your own through the Internet, through the Colorado Bar Association, or other resource of your choice. If you contact lawyers on your own, some may give free consults and some may not. Be clear on that - that's between you and the lawyer. Also look into whether you could qualify for any type of government-funded caregiving resources in light of your daughter's condition. Good luck to you and your daughter, and I hope the treatments help her.
