Q: I was told that I had to have surgery in order to be represented in a suit against the apartments where I reside

I was told that I had to have surgery in order to be represented in a suit against the apartment where I reside the ceiling fell in on me and I have be having back leg and elbow issues they also made me move my apartment on my own to a new unit I need representation because I hw e kids I have to support and this back in other I juries are preventing me from making my living and bills are forming

A: Medical expenses are a major component of this type of claim, but having surgery is not necessarily required. Lost income and other expenses are also relevant to damages. You should discuss with an attorney.

A: I imagine a lawyer told you that they would not take the case unless you had surgery, because then the claim would be much larger and would be worth their time and effort to accept you as a client. It is not a prerequisite to making a claim or recovering damages in such a case. However, if surgery is medically recommended or necessary, then you will need to seriously consider having it. Regardless, you can obtain a medical opinion as to the cost of such a surgery, and use that as part of the basis of your claim; however, the doctor would have to state that surgery is medically necessary.

A: A physician is the one who makes the call about surgery. You could get medical opinions on that, and if you then determine the surgery would benefit your well-being and recovery, you could consider it. Good luck
