Orlando, FL asked in Consumer Law and Sexual Harassment for Florida

Q: Can a man use a women's fitting room or a woman use a men's fitting room?

I work for a department store as a fitting room attendant. I did not allow a woman to take her son (Who appeared to be about 12 years old; the shirts he was trying on were from the men's department.). I asked the woman to not take her son into the female fitting room. This is appropriate in my opinion. I'd like to know what the law is regarding this situation.

A: There is no statute or other law which would cover this situation. It would depend upon the policies of the store. Frankly, however, I don't see any problem with what the woman did, or she could have simply sent the son into the men's fitting room and asked him to come out with the shirt on.
