You need to provide much more information, such as what type of "Pension?" Terminology is very important in these type of issues. There are big differences between IRA, 401K, employer--provided benefits, etc.
Hence, is it a "private" pension, through an employer?
Who is "They?"
Is there a written agreement governing the creation of the Pension? If so, that's where you need to start.
