Q: I have a vehicle service contract and they are declining a repair. What kind of attorney do I need?

I have a liftetime vehicle service contract for my 2012 Chrysler 300C with 130,780 miles. My shocks are a covered component but they are refusing to cover them stating normal wear and tear on the vehicle. If the suspension is considered normal wear and tear for 130,780 miles I would believe that would be the same for all components on the vehicle. How do I have a lifetime service contract if they do not cover any components after 130,000 miles. My contract does not say anything about the suspension or any other component not being covered after 130,000 miles.

A: Sounds like a fraud to me. I'd seek out an auto fraud attorney and/or someone who handles lemon law. Good luck to you on it.

A: If the shocks are covered, and you need to read this contract carefully, they are obligated to cover the work. You may need to have the work done elsewhere, and sue them in small claims. You can recover the cost of the repair less any deductible or co pay, plus the value of the loss of use, perhaps one day vehicle rental, if you are lucky and the judge thinks they unreasonably denied the claim. It is called "breach of the covenant of good faith and fair dealing."
