Q: how do I get a divorce in California from my vietnamese wife while we both are living in Vietnam.

I have been living and working in Vietnam for the last 3 years. Last year while on vacation my Vietnamese girlfriend and I got married in California. She has a Taiwanese passport so we didn't need a Visa or fiancee visa. Now she wants a divorce and neither of us have been living in California for the last 3 years. We have no property or anything to divide. We just want a simple dissolution of the marriage. How can I go about achieving this? Can I do this by myself? Can my father who lives in California represent me? How much will it cost? I've researched the forms, FL-107, FL-100 and FL-110. Would this be all that I need or are there other steps that would be required?

A: The only way you can qualify to file for divorce in California is if you meet the statutory residency requirements, which it sounds like you don't. As you do not live in California and you have not lived here for more than 3 years and it does not sound like you have any plans to live here in the near future, you cannot file for divorce here.
