Q: I’m charged with battery. The victim said they hit me first and all I did was hold them and leave. Is the case strong?

The victim is my mom. I got into a argument with her and she hit me. I stopped her by grabbing her by her wrists. And when she continued I grabbed her shoulders and asked her to calm down.

I left because she continued to try and hit me and the police was called on me. I got arrested and she told them she hit me first and my court date is on Tuesday . I love my mom. It was a simple argument. Family has there hard times and sometimes it gets serious. I wouldn’t try to hurt my mom. I just was getting hit in my face and I stopped her. I didn’t hit my mom or anything. I just held her arms . I left. I just wanna know which the information of her hitting me first and also me only hold her arms , is the case strong to prosecute me? I have no record. This is my first legal problem. I am 21. ( when I say she told them she hit me first I mean the guy they send out to talk to the victims to get their story. The DA sends the guy out . But yeah she told him )

A: You get a defense attorney and if you can't afford one then you might be able to get a public defender. If you handle it yourself then just continue to tell your side of it and be very consistent in what you say.
