Sacramento, CA asked in Employment Law and Immigration Law for California

Q: My boyfriend is here from South Africa for work. He works in Mississippi as a farm hand.

He states he’s not able to leave his employment to come to California and see me. What prohibits him from leaving?

A: No one here can know that. There is simply not enough information in your post to know what is preventing him. His employer? His immigration status? A court order to not leave the state?

Good luck to you.

A: I agree that there are too many reasons as my colleague mentioned. There is always the possibility that he is misinforming you. Questionable requests for money from people on the internet can be a source of fraud. He may be in Ghana or Nigeria for all that yo know.

He may not want to leave because his job is at will, so he may get fired if he takes a vacation. He may not have enough money to travel. He may not have a work visa. He may also have other legal challenges. He may fear being stopped by ICE, then be asked for proof of lawful visa status.

If you have concerns, and do not want to maintain a long distance relationship, then you both need to decide what you can do about it. Should it be to petition for him, then I strongly recommend an appointment or Zoom Conference with a competent and experienced immigration attorney.

A: I agree 100% with Mr. Pedersen and Mr. Dixler. Unless you have met him, I think you are being scammed. DO NOT SEND MONEY TO THIS PERSON, unless you are wealthy and want to just give it away to a potential fraud.
