Q: Hi, Can you please tell me how the SOL in Virginia is calculated ? Thank you !

Hello, can you kindly please let me know how the SOL is considered in Viriginia. If the problem occured on April 15 but you did not discover the issue until May 15 , is this the date you can use to determine when the SOL ends ? I am having a challenging time finding an attorney due to complex issue or its to involved for most people and I undersnad that.. THE SOL is coming up and I am not sure how its determined ..when it ends ? I dont want to give up unless iI HAVE TOO...

A: A Virginia attorney could advise best, but it's already past April 15th. Instead of losing further time awaiting a response, you could continue your efforts to reach out to attorneys. However, it looks like you've already been doing that. In these types of situations where the statute of limitations is right on the cusp, it could be difficult to find a law firm that is interested, which explains the results you've been having. Even if a firm was willing to explore the possibility of asserting the discovery rule (which is generally filled with specific nuances in many jurisdictions, and only a Virginia attorney could advise as to the operation and applicability there), the firm would recognize the risk to themselves in contemplating accepting such a case. Two of the options a person might have in such a situation is to continue reaching out to firms or consider handling the matter themselves. Good luck
