A: Well, a wrongful detainer action (WD) is where the owner of the home claims that there is a person living in the property who doesn't have a legal right to be there. If the owner files, it will come before a judge who will need to make a determination as to whether the person alleged to be living there has a legal right to be there. If the Judge rules that the person does have a legal right to be there (ie a tenant, etc.), then the case is dismissed. If the Judge rules that the person doesn't have the right to be there, then the Plaintiff will have the right to evict the party, provided the rules are followed (ie. no self-help eviction, filing of warrant of restitution, etc.).
