Long Beach, CA asked in Employment Law for California

Q: Employer breaks OSHA laws, rules from employee handbook, plus bribes, threats etc. Do I have a case?

Employed at a franchisee owned chain restaurant for 3 years. I work 100+ hours per week, 7 days and at times it is with incorrect or missing OT pay. I work 12-16 hrs/day with no breaks and threats of termination if I call off. I have been bribed, threatened with termination, accused of stealing, and slandered to corporate higher ups. I had my personal belongings stolen and destroyed, my phone and wallet were gone through by a co-worker without my knowledge or permission. There was no action from the owner after bringing it to his attention. I have been sexually harrased and after reporting it, the owner joked and mocked me. I have had my life threatened in store during work shifts more than once with the same inaction. I was forced to work or be terminated when I brought results and a Dr.'s note to be given time off when I tested positive for Covid-19. I was only given 4 days family leave to be a caregiver for 3 weeks after my wife's kidney transplant. I have documentation and proof

A: Your post suggests that you have multiple claims against your employer. If you wish to pursue those claims, you should locate and consult with an employment law attorney who can learn more about your situation and plot out your path.

As to OSHA violations you can report those directly to OSHA. You cannot sue your employer for violating OSHA regulations.

Move quickly to consult with an attorney. Some of the claims you have can expire relatively quickly. Do not lag and lose important and valuable rights.

I would suggest you either look on this website or go to www.cela.org, which is an organization whose members are dedicated to representing employees against employers. Most attorneys in this field will provide free or low cost consultations, and if your case has value and merit, they will offer to take the case on a contingency fee basis.

Good luck to you.
