A: I am sorry but your post does not make much sense. It sounds like you are in need of a good workers compensation attorney who can be allowed to learn all of the facts of your situation and protect you through the workers compensation process. That attorney can tell you more but generally you cannot sue someone for things said in a legal proceeding.

Good luck to you.

A: The WCAB does not have jurisdiction over Slander, that is a Civil tort for Superior Court ruling. You write should you file 'this'... If you have clear written elements proving Slander, take them to a Civil Tort Attorney and find out what it will cost to file and prove up your case. 'Discrimination' complaints can be presented to the state, the federal Equal Employment Opportunity Commission, depending on which statute you can prove was violated. MOST ATTORNEYS WILL NOT because if the statement you consider to be unfair is part of litigation in a comp claim, the parties are not liable. Assertions made as part of litigation are protected speech.
