Q: My employer is trying to force me to resign because I am not boosted when it wasn't a job requirement. Can I sue?
I recently got off the phone with someone from HR at my company and they told me that I need to get the booster or present a negative covid test every 72 hours if not I am will need to submit my resignation. The HR person told me that it is part of working at the company and not just at the hospital that I am working at as a contractor, but when I was interviewed I wasnt asked if I was boosted just that if I was fully vaccinated. In the job listing when I applied it just asked if I was fully vaccinated but not fully vaccinated and boosted. I do not want to take the booster and since it wasnt mentioned to me at all until now after three weeks of being at the company and already working on site at my designated hospital without being boosted I am wondering if its possible to file a lawsuit if I am forced to resign?

No one can force you to resign. Resignation is a voluntary act by you. However your employer can terminate you if you refuse to do what is required of you, including getting boosted. You would not have a meritorious legal claim if you are fired because you refused to follow the company's booster policy.
