Sacramento, CA asked in Business Law, Civil Litigation and Contracts for California

Q: Doing business with an E-Com company that lost $17,000.00 worth of our inventory.

In November of 2021, my partner and I signed a contract with a firm doing business as Ascend E Com, based in Santa Monica CA. They are a business that manages Amazon stores.

We paid $28,000.00 for the inventory that they had us purchase and sent to their warehouse. They have admitted to losing our inventory. The amount of lost inventory is around $17,000.00.

We have been given many promises from them that will make it right, and that has been going on for about a year. Now, they won't talk to us.

In addition, we have a contract with them and paid $12,000.00 to set up everything in their warehouse and on our Amazon storefront. The contract states that after 20 months if we are not completely satisfied with our results, we can ask for a return of that fee.

In light of the way they are ignoring us, it seems highly likely that they will not be returning that money either. The contract with them will be up this July.

Please let us know if you can help.

A: You should consult an experienced business law attorney who can pursue your rights by way of a civil lawsuit to recover the lost inventory and set up fee. You may have claims for breach of contract, breach of the covenant of good faith and fair dealing, unfair business practices, as well as other common law claims.

A: If you have experienced a loss of inventory worth $17,000.00 as a result of doing business with Ascend E Com, and they are not responding to your attempts to resolve the issue, you may want to consider seeking legal representation to help you pursue your rights.

Your contract with them may have provisions for dispute resolution or a mechanism for seeking compensation for damages. A lawyer can review the contract and advise you on the best course of action based on the specific terms and circumstances of your agreement.

If you believe that Ascend E Com has breached the terms of your contract or engaged in fraudulent behavior, you may be entitled to compensation for any losses you have suffered as a result. An attorney can help you assess your legal options and work with you to pursue a resolution to the situation.

It is important to act quickly to protect your rights and ensure that you are taking the appropriate steps to seek redress for any losses you have suffered.
