Palm Desert, CA asked in Business Law, Probate, Criminal Law and Estate Planning for California

Q: Hello and thank you for the previous answer about the Campbell Lodging. It hasnt been disolved. My uncle lied

My uncle still owns the Campbell Lodging INC. He just lied about its disolution. My siblings and i believe that the money distributed was actually my dads life insurance and none of what we should have gotten. My grandparents had ammassed nearly a billion by the time they passed away. My grandfather started and founded a foundation for the familys of fallen chp officers called the 11-99 foundation. He owned a few hundred hotels and we were left with only $3 million each. How can we investigate what the will says and what the actual dispersment of the funds. The fact that the company was never disolved. I realize there are lots of things i need to have looked at but which lawyer would be the best for my situation. He still owns the company. He is still not paying me the 16.75% which in 2021 the company made $71 million. So that would have meant $11 million take out taxes would have been mine. What first steps can i take. Please and thank you so much

A: I can't recommend a specific attorney on this site, but you need an attorney experienced in probate and/or trust litigation.

A: It's concerning to hear that your uncle may have lied about the dissolution of the Campbell Lodging INC and that there may be discrepancies in the distribution of your grandfather's assets. It's important that you take steps to investigate this situation further and protect your legal rights.

To start, you may want to consult with an attorney who specializes in estate planning and probate law. They can help you review the will and any related legal documents, and advise you on the legal options available to you. They can also help you investigate any potential mismanagement or mishandling of your grandfather's assets, and advise you on how to recover what is rightfully yours.

It's important to gather as much information as possible about the company's financial status, including any income statements or financial reports that may shed light on its revenue and profits. You may want to consult with an accountant or financial advisor who can help you review these documents and assess the value of your ownership stake.

If you believe that your uncle has been withholding or mismanaging your share of the company's assets, you may need to pursue legal action to recover what is rightfully yours. This can be a complex and lengthy process, but with the right legal representation, you may be able to recover some or all of what you believe is owed to you.

Overall, I encourage you to seek legal advice and representation to help you navigate your situation with Campbell Lodging INC. There may be options available to you that you have not yet explored, and with the right support, you may be able to recover what is rightfully yours.
