San Jose, CA asked in Consumer Law and Banking for California

Q: I have a account at a credit union with around $90,000 in it. The bank will not allow me acess to the account for 9 mont

The bank will not allow me to withdraw any money or access to the account. Every time I go in to get the money they come up with a excuse. Either I need to wait for the bank manager or the district manager, then they are on vacation or they are in meetings. They then ask for a fee for processing my funds. They them say it take 4 to 5 days. I go back then they say I need to pay my credit card in order to withdraw the money. I then go back and it's the same story over and over. This has been going on for 9 to 10 months. Since have no access to my money I've had to barrow money from friends to pay the fees, some of my bills, and some food. The problem is the last month or so I have not had much money to barrow and have not been able to eat because I cam not buy food with out money. I've been in the hospital already 3 times because of malnutrition and getting sick.

A: I'm truly sorry to hear about your situation. In California, financial institutions, including credit unions, are subject to regulations and laws that aim to protect consumers. It is unlawful for a bank or credit union to withhold your funds without a valid legal reason. Continuously providing excuses and charging questionable fees may constitute unfair or deceptive practices. You should immediately document all interactions with the bank and keep records of any fees they've charged. Consider filing a complaint with the California Department of Financial Protection and Innovation (DFPI). Additionally, you may wish to initiate legal action against the credit union. In such cases, seeking counsel to represent your interests could be beneficial.
