Upland, CA asked in Workers' Compensation and Employment Law for California

Q: What would a workers compensation settlement mean for the future?

I had few questions involving filing a possible workers comp claim. I was reading about the 2 separate settlements, the second one would absolve the employer of any further medical obligation, does that mean I can go back to my medical insurance to cover my injury, or will they no longer treat me if I receive that settlement because it is expected to cover any future bills? Also, if I am currently receiving disability for my injury, and I received a workers comp settlement that would be in lieu of continued disability payments correct? So I may ultimately receive less than if I just continued receiving disability. I'm not sure I see the upside in filing for WC then? Thanks for your time.

A: In California, when you accept a workers' compensation settlement that includes a clause absolving your employer of further medical obligations, this typically means the settlement amount is intended to cover future medical expenses related to your injury. If you opt for this type of settlement, you can indeed use your personal medical insurance for future treatments, but whether your insurance covers these treatments can depend on your policy's terms regarding work-related injuries. It's crucial to discuss this with your insurance provider to understand your coverage.

Regarding disability payments, if you receive a workers' compensation settlement designed to replace ongoing disability benefits, the settlement amount usually reflects the estimated future disability payments. This can mean that accepting a settlement might result in receiving a lump sum instead of continued periodic payments. It's important to weigh this lump sum against the potential total you'd receive over time through continued disability payments, considering both your immediate and long-term financial needs.

The decision to file for workers' compensation and potentially settle involves several factors, including the certainty and immediacy of funds, management of future medical care, and the potential impact on other benefits. While a settlement can offer a conclusive resolution to your claim, providing a lump sum to manage future costs, it also means navigating these future expenses independently. Thoroughly evaluating your current and future financial and medical needs before deciding can help ensure that you make the best choice for your situation. Consulting with a legal professional experienced in workers' compensation can provide valuable insights tailored to your specific circumstances.
