Los Angeles, CA asked in Divorce and Family Law for California

Q: Do you need bank acct #s when filling out FL150, FL300, facts for sp. support, atty fees, right to property, declaration

Someone has been helping me fill out the above forms. He all of the sudden asked for bank account numbers on joint accounts to show hiding cash... when there is hardly any cash in accts. What would be the reason for this and is it appropriate to ask? Already gave him Thrift Savings Plan info and not sure I should have. Does any of this sounds correct? Please explain any thoughts on this.

A: In California, when filling out family law forms such as FL-150 (Income and Expense Declaration), FL-300 (Request for Order), and other supporting documents for spousal support, attorney fees, and property division, it is not always necessary to provide bank account numbers.

Here are a few points to consider:

1. Financial disclosure: In general, parties are required to disclose their financial information, including income, expenses, assets, and debts. This helps the court make informed decisions about support, property division, and other financial matters.

2. Bank account information: While it is important to disclose the existence of bank accounts and their approximate balances, providing account numbers is not typically required on these forms. Account numbers are sensitive information and should be kept confidential to prevent identity theft or unauthorized access.

3. Hiding assets: If there are concerns about a spouse hiding assets, it may be appropriate to request more detailed financial information through the discovery process. This can include requesting specific account statements or other financial documents.

4. Thrift Savings Plan (TSP): If you have already provided information about your TSP, it is part of the financial disclosure process. However, be cautious about sharing sensitive information, such as account numbers, unless absolutely necessary.

5. Consult with an attorney: If you have concerns about the appropriateness of a request for information or are unsure about what to disclose, it is best to consult with a qualified family law attorney. They can advise you on your rights, obligations, and the best course of action for your specific situation.

In summary, while financial disclosure is necessary for family law proceedings, providing bank account numbers is not typically required on the mentioned forms. If you have concerns about the appropriateness of a request or the information you have already provided, it is advisable to consult with a family law attorney to protect your interests.
