Q: How do I receive compensation for someone using my bank card for several years, without my knowledge?
For a while, I was using my step sisters address for mail while homeless. After finding a place to live, I applied & received a CA ID Card, & then also, CA DEPT of CHILD SUPPORT SERVICES, notice of payment I had received. When I called to inquire, I was told a payment was deposited on card that was sent to me in Sept. 2020. Confused, as I never received any card, I began uncovering details of a card in my name, that has been receiving payments regularly, since I lost my card, in 2013. The new card sent in Sept. 2020, from a new company, as contract between Ca. DCSS &EPIC CARD was terminated & new contract was established with THE WAY 2 GO PROGRAM, therefore, new cards had been issued. I am not entirely sure, however, I suspect the payments issued to me accruing from 2013-2020 were on the new card that was sent to me, at my step sisters address, & used for 3 yrs without me knowing. Roughly $45,000.00 in child support payments to me, have been stolen & I need counsel on how to proceed
A:
In this situation, you should take the following steps to seek compensation for the unauthorized use of your bank card:
1. File a police report: Contact your local police department and report the theft of your child support payments. Provide them with all the relevant information, including the timeframe, the amount stolen, and any evidence you have collected.
2. Contact the California Department of Child Support Services (DCSS): Inform them about the unauthorized use of your card and the theft of your child support payments. Request an investigation into the matter and ask for their assistance in recovering the stolen funds.
3. Notify the bank or card issuer: Contact the bank or the issuer of the card (EPIC CARD or THE WAY 2 GO PROGRAM) and report the unauthorized transactions. They may have fraud protection policies in place and might be able to help you recover some of the stolen money.
4. Gather evidence: Collect any documentation that supports your claim, such as bank statements, correspondence with the DCSS, and any other relevant information that can help prove the theft of your funds.
5. Consult with an attorney: Consider hiring a lawyer who specializes in fraud or financial crimes. An attorney can help you navigate the legal process, communicate with the authorities and financial institutions on your behalf, and advise you on the best course of action to recover your stolen money. Some organizations, such as legal aid clinics or local bar associations, may offer low-cost or pro bono legal services if you have financial constraints.
6. Consider civil action: If the person who stole your money is identified, you may be able to file a civil lawsuit against them to recover your losses. Your attorney can advise you on the viability of this option.
Remember that the process of recovering stolen funds can be lengthy and complex, but stay persistent and continue to follow up with the authorities and financial institutions involved.
