Q: There was a garage fire that melted my HELLCAT back in Sept of 2023. He had dropped the coverage to liability 4 days bef
Before the fire. There was still several days left in the month where the premium was paid already. They refused to pay for my car to be repaired and everything . But they have sent the insurance premium to the collection agency and have stated that the policy wasn't cancelled till January. Beings they sent the policy premium to collections for non payment and Stating that it wasn't cancelled till months after the fire are they responsible for covering my car and having it fixed? It's a Farmers Insurance policy and our of Texas.
The agent had made him write something and I guess he ailed to him but I wasn't aware of him changing the coverage on my car and never agreed to any of the changes and I believe I was listed as the driver on my car because I was the one that drove it.
Farmers sent it to credit collection services I believe January 17,2024.
A: A Texas attorney could advise best, but your question remains open for three weeks. Your question presents things that need to be sorted out for an attorney to advise meaningfully. Who is "he," the person who dropped your coverage? Why weren't you the one in dialogue with the carrier regarding your coverage? The collection action you describe is separate from the property & casualty loss issue - which is more a matter of was there or wasn't there a policy in effect, in addition to a closer examination of the elements of the cancellation. This could be a contentious claim because what you describe is not a cheap car. One option is to try to arrange a free or brief/limited consult with an attorney to discuss things in more detail. You could also discuss the possibility of coverage under the garage policy, which could require more facts than are included in your post. Good luck
