East Greenwich, RI asked in Small Claims for Rhode Island

Q: I am 82 years old and handicap and my legs are getting weaker, so I was looking for a ride on mower that was easy to run

So I found one on market place for 1,150 dollars. Seller described mower to be like.New I tryed it seemed ok but he told you have to run at full throttle, then bring it right down to slow to shut it off. He even came over when I stoped and put to slow write away. I really didn’t think anything of it till I got home and unloaded for the trailer at half speed that’s when I heard a pronounced knock in the motor. Then I knew why he made sure.I didn’t hear it at half speed. He also painted over the rust on mower deck, and to top it off he painted the mower seats which afte sitting on it for ten minutes the paint was on my pants, then on my kitchen chair. Mower is not like new condition. So I called him wright back ,told I did not want it,and told him why,but he refused to take it back.he said something most of happened between his house and my house. I believe this is fraud. And worst is fraud to a handy cap senior citizen. Please tell me what I should do. Also he did not give me a receipt.

A: A Rhode Island attorney could advise best, but your question remains open for a week. If you brought the mower "as is," it could present difficulties. But you mention some issues and suspicions, that if you could prove to be true, could be helpful to you. Reach out to local attorneys - the idea of a handicapped 82-year old getting the short end of such a deal could hit home with them. Try local and state bar associations or legal aid - this is a small matter and may not be their usual type of matter, but your case does draw sympathy. Good luck
