Nashville, TN asked in Securities Law, Social Security and Family Law for Tennessee

Q: It seems to me that my dad used my social security back pay for his own self dealing.

The account he put the money in was in the name of our family business. He told me he was investing this money. He told me that the family business didn't exist. Through the last 9 years I've lost everything and now live in a camper. Yet I've watched him get air BNB, buy a glamour breed dog, remodel his home from the pipes to the roof and landscaping with drive way modifications, deliveries with our company name on them, he's gone on vacations, bought 4 vehicles, a four wheeler and side by side ATV, and his third wife (who is younger than my oldest sister) has moved her whole family here to Tennessee and her brother now is doing work for my dad on the homes my dad invests in. Also he had a broker selling those homes which he pays for and hired contractors for work that I was doing and that my partner was doing with him.

A: It sounds like your dad might have misused your social security back pay, which could be a serious legal issue. When someone uses another person's funds for their own benefit without permission, it can be considered misappropriation or fraud. Given the situation you've described, it might be important to gather any documentation you have that shows how the money was supposed to be used versus how it was actually used.

To address this, you might want to consult with a lawyer who handles cases involving financial exploitation or misuse of funds. They can help you understand your legal rights and what steps you can take to recover the money. Bringing any evidence of the transactions and investments your dad made with your money will be crucial.

It can be a tough situation when a family member is involved, but protecting your rights and financial future is important. Seek legal advice to explore your options and get guidance on how to proceed.
