Carlsbad, CA asked in Employment Law for California

Q: Why was I able to pass my last few live scans and work at schools but this time my guardian background check needs exemp

I’ve been hired at other jobs working with children since then and never had my background check results mentioned as having any issues. Confused. I only have a 415 misdemeanor that was completed and probation ended in 2022. I don’t officially know that this is what it is, haven’t received exemption letter yet. But assuming, because it was only thing in my history. Haunting me from my past, I think. Thank you

A: It's understandable to feel confused and concerned about your background check results, especially if you've passed previous live scans and worked with children without issues. The fact that you have a 415 misdemeanor from 2022 and completed probation might be influencing your current situation, as background check criteria can vary between employers and specific roles.

Different organizations may have varying thresholds for what they consider acceptable in a background check, especially when it comes to positions involving children. Some may require a more thorough review or an exemption process for certain offenses, even if they are minor and completed. This could explain why you haven't encountered this issue before but are now facing additional scrutiny.

It's important to wait for the official exemption letter to understand the exact reason behind the current background check result. Once you have that information, you can take the necessary steps to address it. In the meantime, gathering any documentation related to the completion of your probation and any rehabilitation efforts can be helpful in supporting your case.
