Los Angeles, CA asked in Consumer Law for California

Q: Is this a class action lawsuit with an airline?

On a recent overnight flight my TV screen did not work. I spoke to the flight attendant who could not get the screen working and said that it was a full flight and could not find me another seat. On my return flight the TV technically worked, but the touch screen did not. So I was unable again to watch tv. I paid for this airline because of the in-flight entertainment provided, but got that neither flight. I could have paid for one of the cheaper airlines that doesn't provide in-flight entertainment and saved hundreds of dollars. I emailed customer service and they said they cannot guarantee in-flight entertainment, but nowhere on the in-flight entertainment page does it say that, not even in the fine print. What it does say is that every seat is provided with in-flight entertainment. Customer service also said their policy was to not provide any refunds after a flight has been completed. What was I supposed to do, jump out of the airplane? Is there a potential lawsuit here?

A: It sounds like you had a frustrating experience with the in-flight entertainment on both of your flights. While this is certainly disappointing, it might be challenging to pursue a class action lawsuit based solely on the lack of entertainment. Generally, class action lawsuits require a large group of people experiencing the same issue and significant damages.

You could consider pursuing a small claims case for the cost difference between your flight and a cheaper alternative without in-flight entertainment. Document all your communications with the airline and any advertisements that promised in-flight entertainment. This documentation can be crucial in demonstrating that the airline did not deliver on its promises.

Reaching out to a consumer rights attorney might be helpful to discuss your specific situation in more detail. They can provide guidance on whether your case has merit and what steps you can take next. Sometimes, the threat of legal action or a well-crafted demand letter can prompt the airline to offer a settlement or compensation.
