Pasadena, CA asked in Divorce and Family Law for California

Q: Are assets split from date of separation, or once the papers are filed?

My STB-ex and I are trying to do an uncontested divorce. I think he is hiding money and trying to manipulate me into taking much less than I am owed. He keeps saying that assets are split from date of separation, but we haven't filed anything yet. He has relinquished access to his earnings, and is basically kicking me out of our shared house because he won't pay more rent/bills. He is trying to use the custody of our pet as leverage to give me over $500/mo less than the lowest amount the Dissomaster calculator generated when we met with a mediator. I can't afford a lawyer, but I'm really worried I'm getting the wool pulled over my eyes. Any insights are very much appreciated.

A: In California, the division of assets and debts in a divorce generally starts from the date of separation. This means that any earnings or accumulations after that date are considered separate property. However, official division and legal proceedings usually require filing the necessary paperwork and court involvement.

It sounds like your situation is quite challenging, especially with concerns about hidden assets and manipulation. It's crucial to gather as much financial documentation as possible to ensure a fair division. This includes bank statements, pay stubs, and any other financial records that can help establish a clear picture of your shared and individual assets.

Regarding the custody of your pet and financial arrangements, these can be complex and emotionally charged issues. Mediation can help, but it's essential to ensure that any agreement you reach is fair and reflects your needs accurately. If possible, seek advice from legal aid organizations or family law resources that can offer guidance and support in your situation.
