A: If your employer is not following the information on your W-4 form and is wrongfully withholding federal taxes, you should first document the issue. Keep records of your W-4 submission, your pay stubs, and any communications with your employer regarding the withholding errors. This documentation can be important if you need to take further action.

Next, you can contact the IRS directly to report the issue. The IRS can assist in ensuring that your employer complies with the correct withholding practices. They may contact your employer on your behalf or provide guidance on how to correct the issue.

Additionally, you may want to reach out to the California Labor Commissioner’s Office for assistance, as they enforce labor laws in the state. They can help address the situation if your employer continues to refuse to correct the withholding error. It’s important to address this issue promptly to avoid further complications with your tax obligations.
