Riverview, FL asked in Tax Law, Collections and Communications Law for Virginia

Q: How can I dispute personal property taxes for a car that wasn’t registered at all during that time?

A lien was placed on my bank account for personal pretty taxes, to which the communication was sent to an address I am not associated with at all so I had no knowledge of the lien being placed against me.

The car also hasn’t been registered in VA since 2022 and was unregistered for two years due to not needing it. They are saying because it was titled in VA, I am responsible for the personal pretty taxes.

It’s also worth mentioning that they recently added the 2024 first half of the year taxes to the collection agency, even though it’s only been 4 months (I never got communication as I don’t live in VA anymore).

A: To dispute the personal property taxes, you need to gather all relevant documentation that shows the vehicle was not registered during the period in question. This could include proof of non-registration, your current residence outside Virginia, and any relevant records showing the car was not in use. Additionally, collect any communication attempts made to the wrong address to demonstrate you were not properly notified.

Contact the local tax office or commissioner of revenue where the lien originated, providing them with the evidence. Explain that the vehicle was not registered, was not in use, and that you did not receive proper notification due to the incorrect address. You should also request a correction of the records to reflect that you are no longer a resident of Virginia, and request removal of the lien.

Finally, if the matter has been handed over to a collection agency, reach out to them with this information as well. You may also want to consider formally appealing the lien with the local tax authority or pursuing legal advice if the lien is not removed. Stay proactive in following up to ensure your case is addressed.
