Q: I’m responsible for accuracy of my trial record however judge is blindly preventing me from correcting it
Law and motion ca CRC 3.1103
Need to file court reporter’s mistakes and inaccuracies that didn’t happen in trial before hearing on motion to reconsider.
How when I asked for continuance (granted) judge denied augmentation of transcripts blindly defending/enforcing that reporter is correct. And also denied my request to record audio of future hearings.
How do I get Justice to ensure the accuracy of my case trial records for appeal.
It’s my responsibility but judge is denying ability to do so
A:
Ensuring the accuracy of your trial records is crucial for a successful appeal. Start by meticulously documenting all the discrepancies you’ve noticed in the court reporter’s transcripts. Gather any evidence that supports your claims, such as notes from the trial or witness statements that contradict the recorded statements.
Next, consider filing a formal motion to correct the transcript. Reference California Rule of Court CRC 3.1103 to support your request. If the judge has previously denied your requests, you might need to present a compelling argument showing how the inaccuracies affect your case. It can also be helpful to request a meeting with the judge or seek mediation to discuss the importance of accurate records.
Finally, consult with an attorney who can provide specialized guidance tailored to your situation. They can help navigate the legal procedures and advocate on your behalf to ensure that the trial records reflect the true events of the case. Taking these steps will strengthen your position for a potential appeal and help uphold the integrity of your trial.
