Q: My apartment community manager issued me a $50 lease violation for not breaking down boxes going into the recycling bin

My question is, since nothing about trash/boxes is in my lease, besides the normal “don’t trash the place” language, can I be issued a monetary lease violation? The addendums also don’t say anything about trash/boxes incurring violation fees, either.

It DOES say:

“AD VALOREM TAXES/FEES AND CHARGES. Unless otherwise prohibited by law, if, during the term of this Agreement, any locality, city, state, or Federal Government imposes upon Us, any fee, charge, or tax, which is related to or charged by the number of occupants, or by the apartment unit itself, such that we are charged a fee, charge, or tax, based upon your use or occupancy of the apartment, we may add this charge during the term of the Lease Contract, with thirty (30) days advance written notice to you. After this written notice (the amount or approximate amount of the charge, will be included), you agree to pay the amount of the charge, tax or fee imposed upon us”

I also didn’t get 30 days notice, (if this applies).
