Q: What are my legal options if there was an employment breach of contract regarding unused accrued Vac/PTO.
Family company bought out, but no new handbook given by new employer. Have an email stating I had 172 hours of accrued vacation/PTO would be honored until late 24/25 when would change to "use it or lose it." Prior handbook states unused accrued vac/pto would be paid with proper notice. Gave 2 wk notice and it was "refused." Asked if needed it in writing or verbal as there was a witness, was told I didn't need to give a written notice and turned down offer to train replacement or alternate on jobs no others knew how to do.
Others outside the company knew I had quit and passwords had been changed before I got to my car. They have "trashed" me to other companies as well. This is a sm. community, so limited jobs available. Can I file for unemployment? Should I approach them directly and ask for the pay or contact their business attorney (we have known him for years) understanding he represents them but really don't want to have to take this to court? What legal options are available?
