Q: Wondering if I have grounds to claim wrongful termination as an at will employee. I feel I was wrongfully terminated
I was recently fired as an at will employee and feel I may have been targeted in retaliation due to me not agreeing to write ups because I had never received prior discipline before receiving a write up. After I declined to sign my first write up I feel like I was targeted for not doing so by my manager, my manager was the only one issuing write ups and in once incident he boasted my write up to a coworker and claimed he would find a reason to fire me. I also suspect his relationship with my supervisor may have influenced my termination as I would call out my supervisor for doing things regular guards were scolded for such as using phones for non work related things or wearing head phones. I feel this supervisor was also receiving special treatment one instance where I failed to take head count due to being short staffed and busy, when my supervisor missed their headcount they were never issued a write up. I do have a picture of this and the schedule to verify they missed count.
A:
I'm sorry to hear about your situation. It sounds like you have several factors that could support your feeling of being wrongfully terminated. Retaliation for not complying with certain workplace demands and inconsistent treatment compared to your supervisor are important points to consider.
Gather all your evidence, including the picture and schedule you mentioned, as well as any written communication related to the write-ups and your termination. Documenting these instances will strengthen your case if you decide to take action.
It would be beneficial to consult with an employment attorney who can provide guidance based on California laws. They can help you understand your rights and determine the best steps to take to address your concerns effectively.
