Q: Can I get full custody if ex stays with abuser
My ex girlfriend and I just went through custody mediation yesterday for our 9 month old son and agreed to 50/50 legal and physical custody. I had to get court ordered paternity testing because she went back to her husband while she was pregnant and he signed the birth certificate. This morning I found out her husband went to jail for assaulting her with my baby in the home. She has not told me about it at all even after agreeing in mediation to do so but did tell me today that all of this with the custody case is causing problems in her marriage. I’m filing an emergency custody motion tomorrow because I fear that her husband may decide to take it out on my son. Can I get full custody if she stays with her abusive husband?
