Q: I need a tenant lawyer in Michigan. I am in emergency need because I've been served a Writ for eviction.

My mother has passed away June of 2023 and I went to her mortgagee 1 month after her death to get deed put in my name and her lender told me not to worry about transferring the deed at that time, just make sure that I keep paying her homeowners insurance. He has never been to my house I had gone to him after her death. The 1st time he came to my house is 2 days after his lawyer came to tell me that my moms property is being foreclosed on because of delinquent taxes. When her lender came to me 2 days after that occurrence her lender told me that I either can pay $80,927 or I need to leave because it would be sold at a foreclosure sale on June 6th, 2024. They both had showed up within 1 week before the foreclosure was scheduled for. He eventually had evicted us and we are currently still in home but we have been served Writ of eviction and I called the sheriff and he told us to call him tomorrow to update him on how much more stuff we need to move out. We have a meritorious defense

A: Michigan is a very large state — are you in Iron Mountain, Detroit, Traverse City or Grand Rapids? … you need to find a LOCAL lawyer who can review all the paperwork and provide actual advice and representation.

Frankly, at this point and from the limited details you provide, you SHOULD have contacted a lawyer in June of 2023 and it may be too late to do much to help at this point but the only way to know for sure is to get on the phone and speak with someone local to help.

A: The writ of eviction is the LAST step in the process, coming after a court granted a judgment for possession against you. As Mr. Zichi said, the time to argue about all this was back in 2023.

Get with a local attorney ASAP. If there is anything that can be done, it'd have to be done on an emergency basis; and quite frankly at this juncture, you'd at best be stalling an most inevitable conclusion.
