Pittsburgh, PA asked in Consumer Law, Contracts, Banking and Business Law for New York

Q: I need a layer to represent me on a breach of contract, and in seeking damages.

I had an account with Payoneer.com, an online money platform, and they blocked my account, and they are refusing to disclose the reason why this happened. I am a professional specializing in AML (Anti-Money Laundering), PCI-DSS, Cybersecurity, and Secure Operating Practices. I have substantial expertise in reviewing and interpreting Terms and Conditions for Payoneer accounts and other rules governing digital financial transactions. Based on my review, I have identified no actions on my part that would violate your Terms and Conditions.

Pursuant to my rights under:

The Right to Financial Privacy Act, 12 U.S.C. §§ 3401-342, and

The GDPR (specifically regarding information required to be disclosed by law or in connection with legal proceedings, as outlined in UK GDPR Exemptions), I formally requested several time disclosure of all information, investigation results, and evidence upon which you are relying to justify the actions taken against my account.

A: What are your damages? Jack

A: I’m sorry you’re dealing with this frustrating situation. To answer your question as to whether you need/should retain a lawyer to represent you in this, it depends on your damages. You can consider filing a claim in small claims court depending on the amount at issue: small claims court will hear without needing a lawyer up to $10,000 so you may not need to hire an attorney. If your claimed damages exceed that, then you'd be best to retain a lawyer to initiate settlement communications and, absent success there, filing a claim in court.

I suggest creating a paper trail by compiling a file containing all relevant documentation such as invoices, the contract (if any) and any correspondence including emails with attachments, letters and voicemails. This evidence will be essential for any steps you choose to take in attempting to recover your losses. Good luck!
