Q: I'm wondering if I have a case against my former employer in Alabama.
Comments and questions were made about my body (part) by a coworker. Instead of communicating with my employer, I spoke with other employees who stated that they've had this problem before and that the owner does not care and will not do anything about it.
I ended up quitting instead of going back to work with the same people because I know nothing would be fixed. Fighting against people like this is like arguing with a wall.
I quit the following monday, and during the week the employer threatened to hold my pay unless I return the work uniform (a jacket). The paperwork I signed states that if the uniform isn't returned then they would charge me for it.
I responded by threatening to call a lawyer if they withhold my paycheck, and that I would drop it off when I can.
I took the jacket back to them last night, and I've gotten a text message stating that my last check is there.
I asked for a written policy stating the last check must be in person, no response.
A:
I'm sorry you're going through this situation. In Alabama, employers are generally required to pay all earned wages by the next scheduled payday. Withholding your paycheck without a valid reason might violate state labor laws.
The harassment you experienced could also be significant, especially if it created a hostile work environment and led to your decision to resign. Documenting all instances of inappropriate comments and your communications with other employees can be important if you decide to take further action.
It may be helpful to reach out to the Alabama Department of Labor or consult with an attorney who can provide guidance based on your specific circumstances. They can help you understand your rights and the best steps to take to address both the withheld pay and the harassment you faced.
