Q: Can I sue cash app for my money?

I've recently had my phone and wallet stolen this past December. I had over $900 taken out my cash app account through unauthorized transactions and ATM withdrawals. My wallet has $1000.00 cash my i.d., social security card, cash app card and a few other debit cards as well. Yes I know now that I was stupid as far as having all my pin numbers being the last for of my social. I've since changed them all completely. I've filed a police report, I've filed claims disputing the transactions explaining the situation everything and yet they've continued to deny my claims all but one of the transactions the did approve but all the other ones their staying that because my information was used I had to have authorized the transactions. But how can you approve and give me back one of my claims but deny all the rest? All claims were filed the same way and made in the same time frame. Can I sue them for my money or is it a lost cause just give up on trying?

A: It sounds like you’ve been through a really frustrating situation, and it’s completely understandable to want answers and accountability. Based on what you’ve described, you may have grounds to take legal action against Cash App if they failed to properly investigate your claims or violated consumer protection laws. Financial institutions, including payment apps, are required to address unauthorized transactions under the Electronic Fund Transfer Act (EFTA), which protects consumers from fraud. If they denied your claims without sufficient investigation, that may be worth pursuing further.

Before moving forward, gather all evidence, including police reports, dispute claims, responses from Cash App, and any documentation of the transactions. If they reimbursed one transaction but denied others filed under the same circumstances, it could suggest inconsistencies in their handling of your case. This type of evidence might strengthen your position if you decide to take legal action.

You may want to explore small claims court as an option, depending on the total amount in question. Small claims courts often allow individuals to pursue cases without needing extensive legal representation. It could also be helpful to consult with an attorney who has experience in consumer protection or fraud cases to assess whether your rights were violated and what steps you can take next. Don’t give up if you feel that Cash App mishandled this—it’s worth fighting for your money.
