Q: Can I sue Facebook for not addressing issues after my father's account was hacked?
I am considering legal action against Facebook due to ongoing issues following my father's passing on August 7, 2023. A year later, his Facebook account was hacked by someone pretending to be one of his children, attempting to sell his estate fraudulently. This hacker also reached out to me, demanding payment to regain access to the account. Despite sending Facebook all necessary documentation, including my father's death certificate, my request for legacy account ownership was repeatedly denied. With my step-brother, who has connections in law enforcement, I was able to obtain a subpoena revealing the hacker's identity as Nigerian, and Facebook was instructed to remove the page. Initially, Facebook removed the page, but the account reappeared two months later, causing further distress. After six to seven months of stress and attempts to get the page removed, Facebook finally complied. However, I've suffered significant stress and exacerbated anxiety. I am maintaining my internet security but remain concerned about the hacker. Can I sue Facebook for failing to address this issue in a timely manner?
