Wetumpka, AL asked in Car Accidents, Education Law and Personal Injury for Georgia

Q: Is a school at fault if it let a child walk home and they were hit by a car?

My child was attending after-hours tutoring at their school, where it is stated on the schedule that transportation would be provided. However, the school allowed my child to leave on foot without parental permission, and they were hit by a car. Is the school at fault for this incident?

A: A Georgia attorney could advise best, but your question remains open for over a week. I'm sorry about your child's accident. In virtually anywhere in the U.S., they could be - depending on additional details about child's age, circumstances of accident, and other details. Consider reaching out to Georgia attorneys to discuss in further detail. Attorneys who handle such cases typically offer free initial consults. I hope your child is okay. Good luck

A: Addendum - 'Just an added point to my response a moment ago. Is this a public or private school system? If it is public, you could be looking at notice of claim requirements. These are very short filing deadlines you must comply with in initiating a claim. I'd advise discussing with Georgia attorneys promptly whether these would be applicable here. In other words, better to act sooner than later. Good luck
