Q: Can I access my personal belongings from a friend's towed car without owner's consent?
I was recently involved in an automobile accident while driving a friend's car in New Hampshire. After the accident, I was taken to the hospital, and the car was towed by a company used by the state police. My backpack and duffel bag containing personal belongings such as medication, cell phones, and paperwork were left in the vehicle. When I attempted to retrieve my items from the towing company, they refused, citing the need for the owner's permission, whom I cannot reach for at least two weeks. I had permission from the owner to use the vehicle and have contacted the state police, but I haven't yet heard back from the officer who filed the report. A friend who came to the accident scene was initially refused access to the car because it wasn't cleared for safety. I was told I could access it after clearance, but by then, I was already at the hospital, and the car was towed. Do they have the right to refuse me access to my personal belongings under these circumstances?
