Q: Roommate asked myself and the third housemate for permission to get a husky puppy. We said no. She got the dog anyway.

She works 10-12 hours a day, 5-7 days a week, and will not have time to properly care for, nor train the animal. She has been told she has 48 hours to get rid of the animal. Both myself and the third housemate are allergic to dogs and do not wish to care for the animal. If she refuses to get rid of... View More

No, you cannot remove or euthanize or do anything to the animal. You have absolutely zero authority to do anything to the animal. Try evicting the roommate, that is a more humane and normal part of life than killing someone else's dog. Or, you could also always move out, too.

Unfortunately, no, there is not. People can more or less treat their dogs like trash under the Denver municipal code. Contact your city representative to get the law changed.

You will need to sue this person in replevin in county court. It is best to do this sooner, rather than later. Report the dog as missing to the chip company, too. You might also want to try calling code enforcement (they handle animal related calls in Englewood) rather than the police.

I’m sorry to hear you have to go to court. From what I can gather from your post it sounds like there’s a history of animosity between you and the neighbor over the dog barking. Without knowing more, I simply would advise you to carefully read the ticket summoning you to court so you can begin... View More

I have paid for all her vet bills and completely taken care of this dog for 3 years while her junkie owner was in and out of jail. It was going to be taken to a shelter had I not driven across the country to get her. Now her owner is out of jail and wants her back. Do I legally have to surrender... View More

This is always a hard question, and the one I get the most often. Unfortunately, if she is the owner and she has never sold or gifted you the dog, she is still the owner and can ask for the dog back at any time. If you feel strongly about keeping the dog, I would recommend offering to buy the dog... View More

Forever.

You can asked to be reimbursed for your costs of care, however, if the owner does eventually come pick up the dog.

I’d say you’re going to spend a lot more on caring for the dog than $1,000 from the sounds of it and if you dint buy the dog from her, now, you’ll...

He can call the police to see if they will help get the dog back, but that’s up to the officer whether they’ll consider it a civil matter or not. If they won’t help, he’ll have to sue.

Q: Can a dog rescue take their non-aggressive, healthy dog away from a foster family to euthanize him?

The rescue legally owns the dog and they can demand him back from you. However, this is probably a liability concern for the rescue to adopt him out to others, although I am a little surprised they want to euthanize him. You could try to negotiate adopting him. It might be helpful to get a lawyer... View More

No, the cops don't know the law. They just say whatever they can to get you to leave them alone about stuff like this. If they saw your paperwork, they should have assisted you, but since they won't, you will have to take her to court. You can take her to small claims, but county court is... View More

Since you're in Canada, I'm not sure the exact laws. In the US in Colorado, the rule on lost property is 5 years. You might want to call around to local lawyers to get a correct answer. But, it seems like the dog would be in good hands if he stayed with you.

Generally speaking, whoever is on the purchase/adoption papers is who the court will award the animals to. If he bought them he would also likely win. More information is needed to answer this question.

Without a written contract specifying everyone’s rights, it’s hard to say what can and cannot be done. Legally, in Colorado, puppies are not supposed to be sold until they are at least 8 weeks old. If the “breeder” gave you a date on which to pick up the puppy and then rescinded, you might... View More

This is an interesting question. The rule for abandoned property in CO is 5 years, but there is case law that protects good faith third party purchasers of dogs. I would recommend speaking to an animal Attorney about your situation because more facts are necessary to properly answer this question.

Possibly. It depends on what the foster contract says, for example, if you were supposed to keep the dog safe and protected from harm. Whether or not they will win on the facts is another question.

Pet stores are notorious for this kind of behavior. They are in it to make a sale, not to care for the living, breathing animals. Pet stores are also very likely to get their puppies from puppy mills. In short, pet stores should be avoided at all costs.
