Q: If a alleged controlled buy is done by an "Unwitting" third person would that be considered a controlled buy?

A search warrant was served after the unwitting person allegedly purchased narcotics from the residence but the alleged buy was not monitored or witnessed by any law official or any individual. Could a Motion to Suppress and or Hobbs Motion be filed in this case?

Go see a local attorney with all the facts. You cannot get a full discussion of the issues on the internet. What do you mean by unwitting? Is that person going to testify? Perhaps it is just that person's word, and that needs to be explored fully.

A child is defined in Iowa Code section 232.68 as any person under the age of 18 years.

Q: On a mandatory three year sentance on drug charge in iowa do offenders get anytime taken off the mandatory three years.

Do offenders get good time taken off there three year mandatory? and if so how much time comes off there three year mandatoy?

Yes. Good time in prison is actually counted against the minimum sentence. That is to say, a person sentenced with a minimum sentence of 3 years can get out before 3 years have expired.

Yes. If police arrive with a valid warrant, and find evidence of an unexpected crime, that evidence can be used against you.

Under Iowa law, the only way to expunge an old theft conviction is if you had received a deferred judgment at the time of the original sentence. Otherwise there is nothing that can be done.
