Q: Hello, I would like to file a patent, I did some searches and only came to this page as the main conclusion.

You are confused. You probably need to file for a trademark. Consult with an attorney.

You might find using the authority of the probate court more effective. With your mother in law gone there is nobody on title who is alive who can report it stolen until one of you gets appointed as executor of her estate.

Q: There are many variations of the tensile tents being manufacturered. At what point is it a different product?

They are different sizes, but is it the shear fact that it is suspended that it is patented?
