Q: Mother passed, children's rights?

My mother and father were married for over 50 years. My mother had died and all their property was under my father's name. Do we the children have any part in a claim due to my mother's death?

Generally no, but why not ask a lawyer in the state where your mother lived at the time of her death?

Life insurance goes to you as beneficiary. You need to call the company --they may ge waiting on some paperwork. The other payment I'm not sure about. Why not contact a member of the Fla. Trial Lawyers Assn? They give free consultations.

You should ask the wrongful death attorney that you hired. The ex might have a claim too.

The first thing you should do is go to social security and see if you can apply for benefits for the children. The second thing to do is to go see a wrongful death attorney.

Q: While I was in prison in Florida my mom died from overdose of methadone, xanax, & ambein ALL prescribed from same Dr ?

She was currently on probation & had a very bad criminal past of drugs, duis, n thefts. I thought these 3 meds couldn't be given together? & also shouldn't Dr did better background check? Can i sue Dr at all.... I'm only child n 34 no family left but me.

yes. there will be a statute of limitations and probably a shorter time limit for a claim against a governmental agency. you need to contact a florida lawyer right away. most initial consultations a free and most injury lawyers work on a contingent %. DO NOT DELAY.
