Q: Will my license be suspended

I’m 17, I got a ticket that I plead guilty too and paid without supervision then i got another ticket that I got supervision for but while on supervision I another ticket will my License be suspended?

Yes, at your age - two convictions within 24 months will cause a suspension. It would be wise to get a local attorney to help you.

That isn’t a violation. Probably 11-601. Failure to reduce speed to avoid an accident most likely. Part of the speeding section. It’s a minor violation.

In McHenry county, the case is not et for trial on the first appearance. The witnesses are not required to appear until a trial date. At the first appearance you can plead not guilty and ask for a trial. Then at the trial date, if the witnesses do not show, the prosecutor might dismiss the case.... View More

Q: I received a ticket for expired license plate. I went to the DMV and paid for a new registration sticker.

I paid for the new registration prior to my scheduled court date. However I was extremely busy with work and totally forgot about the court date! The court date was two days ago, what is the best thing for me to do right now?

Contact the Clerk's Office at the courthouse to see what action was taken. You may need to file a motion to bring the ticket back into court.

Absence of insurance is not a moving violation, yet it a vehicle compliance requirement statutorily designed as cost prohibitive, thus, even with basic liability insurance one saves money even if such motorist is stopped second time and ordered a $1,000 fine plus court costs for the second offense.

If you do not comply with terms of supervision, it will be revoked and a conviction will enter on your record.

If you are under 21, 2 convictions within 24 months will cause a suspension.

If you are 21 or older, 3 convictions within 12 months causes a suspension.

Technically, you can receive court supervision up to 2 times within a 12 month period, but that is ultimately up to the Judge. If a conviction was already entered on the second ticket due to the missed court date a motion would need to be filed to bring the case back into court. An attorney can... View More

Q: I got pulled over for being on phone while driving. My license had also been expired for 3 years.

I didn't get arrested, I was able to drive away from it. I was issued a citation to appear in court in a month. My only other ticket on record is a speeding ticket (10mph over) from 5 years ago. Can I renew my license before my court date? And is there any chance I could get court supervision?

You should not. It can be used against you in any potential civil claim.

If there is a court date, you should appear in court with the renewed registration to attempt to have the ticket dismissed. If there is not a court date listed, you would need to request one.

Q: 2 tickets under 18

My daughter is turning 18 in less than a month. She received one moving violation, and has taken the online drivers improvement course. She just now received another ticket for getting up to speed right before the speed limit sign. How can we keep her from getting suspended?

Technically, she is eligible to receive court supervision twice within a 12 month period, but it is at the judge’s discretion. An attorney may be able to help negotiate an agreement to prevent a conviction from being entered on the new ticket.

It depends on your carrier. Your insurance only covers "licensed drivers." Given that his license was revoked, your brother was NOT a licensed driver. Any carrier could use such an opportunity to legitimately deny a claim. That you were unaware is irrelevant unless he stole the car.... View More

You need to hire an attorney and get a motion to quash on file. Depending on how long ago the warrant was issued, you may currently have a revoked drivers license. Your attorney can help clear that up through this process as well. Then you need to defend or resolve the DUI.

No, if you’re in lake or cook county, you may be able to show up, show proof of updating it, and get it dismissed.

The cheapest way would be to pay the $164 fine. It’s a non moving offense that is not reported to the Secretary of State and does not go on your record.

Yes. You can be placed on supervision two times in any 12-month period. So I’m the last 12 months, you have not been placed on court supervision.

You are not eligible to mail in and request supervision with the traffic school. You can appear in court, plead guilty and request supervision. The judge can grant supervision at that time. You will have to pay the additional court costs to appear in court.
