Even though this situation was under the legal limit, you still could get charged with a DUI under a different subsection of the DUI statute. I would suggest looking for an attorney right away to discuss your options.

Q: So I’m on court supervision and I just got a cell phone ticket will I lose my license for this and I do have a lawyer

You shouldn’t lose your license. Talk to your attorney. 3 convictions if you’re over 21 within 12 months or 2 convictions within 24 months if you’re under 18 are required before you lose your license.

If this is your second ticket and you’re under 21, you should be able to avoid...

Q: Will the judge dismiss my speeding ticket, for a first time offense?

I am a WI resident, and got a ticket for going 15 over in IL. The cop even said my record is pristine. I don’t want to just pay the fine, or go to traffic school. If I show up to my court date - could the judge just dismiss it since it’s a first time offense? I don’t want points added to my... View More

Very unlikely because if everyone’s first offense was dismissed, nobody would ever have a second offense. There may be a few counties that will reduce the charge to a non moving violation but most of them require traffic school or some form of court supervision. If you were in Illinois driver,... Q: Got a ticket for "disobeyed stop sign" and the officer wrote the wrong vehicle on the ticket, can I get this tossed?

All other information is correct - but the vehicle model is incorrect. Would simply arguing that the plate number is not registered to that vehicle be enough?

Not necessarily but not automatically. And the state might, if they discover the error before trial, correct the information.

Supervision is a disposition of guilt that is not a conviction. The Secretary of State keeps track of supervision internally, therefore your insurance company should not find out about it. Good luck. Al

Q: How long does it take for my license to get suspended after getting three tickets?

Last summer I was in an accident where I got a ticket for “driving too fast for conditions.” In hindsight I should’ve fought it because I fell asleep at the wheel so my speed had nothing to do with it, but whatever. Since then, I’ve gotten two speeding tickets. I’m aware that three... View More

It depends on the disposition of each ticket, your age and the offense dates. If you want to pull your ‘court purposes driving record’ from the Secretary of State, I’ll read it for you at no charge. In the meantime, a good rule of thumb is to always try for court supervision to avoid... View More

It's always a smart move to seek good counsel when you have any court cases, especially for Misdemeanor & Felony cases. In the meantime, get your SR-22 certificate on file and then renew your license so by the time you get to court you'll have a valid license - that will mitigate the... View More

Agg speeding 26-34 mph over the limit is a class b misdemeanor. The maximum penalty is up to 6 months in jail and a $1,500.00 fine. Again, that is the maximum penalty. Ideally, a conviction can be kept off of your record through negotiation. Of course, minimizing the fines is also a priority.... View More

The length of the suspension depends upon how many points you will have accumulated. That depends on the nature of the tickets and how fast over the limit you were going. Ticket will probably be dropped if you show up in court. Other driver most likely will not show.

Now Florida has reported to Illinois that you were driving. That violates the driving while...
