Q: Can my sons father get a restraining order dropped its been in place for 6 months now and he didnt even respond.

He didnt even respond to the restraining order and now we are in custoday case in another county he filled in the restraining order is for me and my children. The custody judge said she could over rule it can she? And she told him ti go to my county and get order dropped can he?

Go to MNCourts.gov and find the "Affidavit and Order for Dismissal" form. Then, file it as instructed by the website.

Q: how long do you have to file a domestic report with the police? I am really torn on what to do because I am scared.

I did speak with police yesterday and they told me to let them know my decisions....

Trust me on this - if you are being abused, do it and don't look back. Get away from the abuser at whatever cost. Leave your stuff if behind if you have to, just get yourself out of there. Q: Trying to find legal aid for my son. Domestic abuse - adjudicated in Pine Cty. Charges filed in Isanti Cty next day.

Arrested 04/2015 on 3 felony charges domestic violence. She dropped charges..state kept.

Case resolved 10/09/2015 in Pine Cty, MN.

Felonies dropped.

Convicted 1 count misdemeanor domestic violence.

Legal aid does not typically handle criminal cases. Have him apply for a public defender.

The prosecutor makes the decision whether to drop charges. In your particular case, charges should NOT be dropped. Q: If your fiance has a no contact order when its lifted can he live with you again if your the victim of domestic assault?

If the No Contact Order if vacated then your fiancé can live with you as long as there is no other or order prohibiting him from residing at the residence.

Q: Am i required to testify against my spouse for domestic violence in mn?

My spouse will soon be on trial for domestic violence. In the state of MN, do I have the right to refuse to testify against my spouse in court, even in the case of domestic violence? If not, and if I still refuse testimony, what consequences would follow?

You do not have to testify unless you have been served with a subpoena. If you have been served with one and you do not appear to testify then you could be held in contempt of court and civil and or criminal consequences may follow.
