Hearings can usually be adjourned. I guess you could file a complaint. But more importantly, you need to hire another lawyer, if possible.

She may have medical malpractice claim. Much will depend on the severity and/or permanency of her injury. Medical malpractice cases are time-consuming and expensive for a lawyer to pursue. Best thing to do would be to seek a free consultation with a medical malpractice lawyer who can go into this... View More

Yes. You would need to hire a lawyer in New York. You did not give any information on the alleged defamation. Those types of cases can be difficult to win.

Was the former husband's claim one for loss of consortium? Was any of the settlement amount for that claim? You need to speak with the attorney who settled the claim for the details . Chances are the settlement was only on the wife's injury claim.

Q: What is the statue of limitations on a civil law suit if the case was filed in 2007

If the case was properly filed in 2007 then there would be no statute of limitations problem. The statute of limitations only applies to the date by which a lawsuit has to be started. A case can drag on for years.

That would be hard to say. If there is a lawyer involved, he or she would be the best lawyer to answer any questions about the lawsuit.

I don't think she would have much of a claim, let alone find a lawyer to represent her. I recently wrote an article on the subject of defamation. I have added a link. I hope you find it helpful.

I see nothing in your post that would indicate a viable medical malpractice case. What injuries did you suffer?

You should give the lawyer as much information as possible. If the first lawyer you speak does not think there is a case worth pursuing, you should get a second, or even third, opinion.

Q: How long after an injury do I have before a file a claim

I believe the statute of limitations on personal injury cases in your state is two years. It appears your time to look into a claim has expired. You should contact a personal injury lawyer in your area for a free consultation, nevertheless.

Q: Hello, I was enjoying a candy from a well known company and nearly choked to find a hard piece of plastic in the centre.

I was driving and almost cause an accident. I wrote to the company but they simply brushed me off. I'm pissed! Do I have a potential law suit!!?????

John M DeProspo

No. There would not be enough damages (injury) for a worthwhile lawsuit. Personal injury law compensates accident victims for what has occurred, not what almost occurred. I would follow up with the company to see if they will offer you any type of compensation.

You do not supply much information. You can file a complaint against the doctor with the New York State Dept. of Health. I have included a link to the form.

I am not sure what you mean by saying he "also violated me?"

Yes, you may have a claim. Whether it is a claim a lawyer would think worth pursuing will depend on the nature and extent of your injury. What was your injury? Was a report of the accident made to management?
