Q: How can I verify what service center is processing my i130? Our confirmation number starts in IOE. We live in Florida.

We want to track the processing times. Our ex lawyer said she sent a message to the California center to let them know she is not our lawyer any longer, but we live in Florida so we thought our center was the Texas one.

The I-130 receipt letter you received in the mail should have the location of the service center processing the petition at the bottom of the letter. However, occasionally I have seen USCIS move the cases to a different service center. If you did not receive the receipt letter in the mail you may... View More

Q: What does USCIS mean by "your benefit request has been accepted and is under review"?

My husband filed an i130 petition for me. On the myUSCIS account we keep on seeing the phrase "your benefit request has been accepted and is under review" and the only thing changing is the date they update the page. Does that phrase mean that our file is resting in a drawer or that... View More

It most likely means that USCIS received your petition and payment was accepted. You then wait for your petition to get through the backlog of petitions that are pending before yours is adjudicated.

Under the circumstances and the fact that you have 30 days to depart, the best course of action for you is to speak in person with an immigration attorney that can review and analyze your long history with the immigration authorities. Best regards.

The best thing you can do is find a family lawyer with experience in your area. There are some lawyers that offer a consultation free of charge, that way you can find out first if they can help you before paying for attorney's fees. Best to you.

Q: Our IO after our marriage green card interview said our case was "approvable" but he needed to review. Is this bad?

My husband and I had our marriage green card interview today. We were asked some standard basic questions about our relationship. And our IO asked my husband a lot of questions about his government/military career back in his country (Nigeria), mainly if he had ever used weapons or trained with... View More

Please do not worry. Just because they would like to take some time to review does not mean that you will be denied. If you do not receive an approval letter, you should receive a letter with instructions. If you do not receive a letter within 90 days you should call the customer service number. If... View More

Dear Petitioner,

In order to properly answer your question, I need to know how your son lost his status. Based on those facts we can provide you with a recommendation. If he does not have all the facts, we can request a copy of his record from the government and that would provide the most...

In general, they can leave the United States and turn around and come back in; however, every time your friend re-enters the US with the tourist visa, they have to endure the scrutiny of the border officers asking questions about the motive and length of the new visit. The officers mostly want to... View More
