Unfortunately, you have no leverage, because there is not any money in escrow. You should probably speak to a lawyer and move forward with eviction or whatever that lawyer suggests.

Depending on how long ago this was, you probably can bring a lawsuit. I would suggest speaking with a lawyer that handles car crash cases.

It's not entirely clear to me if your case has been settled yet, or not. If it has already settled and all that is left to do is to agree to the language in the release and sign it - at that point it will be difficult, likely impossible, to renegotiate the settlement.
